California “‘Assault Weapons” Ban Overturned

In a 94-page decision, federal Judge Roger T Benitez described California’s assault weapons ban — in place in 1989 — as unconstitutional and defended the right of Americans to own semi-automatic rifles.

“Like the Swiss Army Knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment,” he wrote. Benitez, citing FBI statistics, said murder by knife occurs seven times more often than murder by rifle.  In 2019, California saw 252 people murdered with a knife, while 34 people were killed with some type of rifle – not necessarily an AR-15. The judge also pointed out that a Californian is three times more likely to be murdered by an attacker’s bare hands, fists or feet, than by his rifle.

However, the state of California is not going away without a fight. Judge Benitez ordered a stay himself to give the CA state attorney general time to make an appeal. Governor Newson said posed a “direct threat to public safety” and which he vowed to challenge. “We’re not backing down from this fight, and we’ll continue pushing for common sense gun laws that will save lives,” he said in a statement.

Anti-gun groups keep pushing unconstitutional gun control as lifesaving legislation, but it really just shows how much the naysayers want to push this narrative of AR-15’s being the cause of innocent deaths. We invite you to read Judge Benitez’s ruling for yourself.
